1. Introduction & Scope

These Terms & Conditions (“Terms”) govern your access to and use of the Auction Armoury (Pty) Ltd (“Auction Armoury”, “we”, “our”, “us”) website, www.auctionarmoury.co.za (the “Site”), including the purchase of any firearms, ammunition, parts, or accessories offered on the Site.

By using our Site or purchasing from us, you agree to be bound by these Terms, our Privacy Policy, and all applicable South African legislation, including:

• Consumer Protection Act 68 of 2008 (CPA)
• Electronic Communications and Transactions Act 25 of 2002 (ECTA)
• Protection of Personal Information Act 4 of 2013 (POPIA)
• Firearms Control Act 60 of 2000 (FCA)

If you do not agree, please do not use this Site.

3. Eligibility & Online Store Terms

• You must be at least 18 years of age and legally capable of entering into binding contracts.
• Purchases of firearms, ammunition, and other controlled items require valid licensing in terms of the Firearms Control Act (FCA). Proof of competency and license may be requested prior to delivery or collection.
• Auction Armoury reserves the right to refuse or cancel any order where proof of compliance with FCA is not provided or verified.
• By purchasing, you warrant that you comply with all legal requirements for possession of the items purchased.

4. Products, Firearms Disclaimer & Safety

• All firearms, ammunition, and accessories are subject to strict compliance with South African firearms legislation.
• Products are sold as-is; Auction Armoury makes no guarantee of fitness for a particular purpose beyond what is required by law.
• Firearms and ammunition may only be transferred to licensed individuals or dealers in terms of the FCA.
• Firearm handling and use is inherently dangerous; you agree to follow all safety rules, training requirements, and storage obligations as prescribed by law.
• Nothing on our Site constitutes training or professional advice. Customers are strongly advised to undergo accredited training before use of any firearm.

5. Orders, Payments & Security

• All prices are in South African Rand (ZAR) and include VAT where applicable.
• Payment methods:
  • PayFast, EFT, credit/debit cards, or other approved gateways.
  • Orders are only confirmed once payment is received and cleared.
  • We use secure payment gateways; Auction Armoury does not store card details.
  • If payment is not authorised, your order will be cancelled.
  • We reserve the right to cancel any order in line with FCA compliance or if stock is unavailable.

6. Delivery & Collection Policy

• Delivery of firearms and ammunition is subject to FCA requirements and may only occur through licensed dealers or approved transfer processes.
• Accessories and non-restricted items are couriered within South Africa. Delivery timelines will be provided at checkout.
• We do not deliver firearms or ammunition to PO Boxes.
• Risk passes to you upon confirmed handover in accordance with FCA procedures or upon courier delivery for non-restricted goods.
• International sales are subject to additional export/import regulations and may be refused if non-compliant.

7. Returns, Exchanges & Refunds

Retail Customers (CPA Rights):

• You may return defective or unsafe products within 7 working days of delivery in line with Section 56 of the CPA.
• Firearms and ammunition cannot be returned due to change of mind and will only be accepted for return if defective or not legally transferable.
• Accessories may be returned if unused, sealed, and in their original packaging unless defective.

Wholesale Customers & Dealers:

• Returns limited to defective or damaged items only.
• Firearms, ammunition, and restricted parts are excluded from returns unless defective and only in compliance with FCA procedures.
• All returns must be reported within 48 hours of receipt.

8. Intellectual Property

• All trademarks, logos, images, product descriptions, and materials remain the property of Auction Armoury or its licensors. No content may be copied, reproduced, or used without prior written permission.

9. Privacy & POPIA

• Auction Armoury processes personal information in compliance with POPIA.
  Information may be shared with SAPS, licensed dealers, couriers, and payment providers where necessary to comply with law or fulfil your order.
• You have the right to access, correct, or request deletion of your personal data, subject to FCA compliance requirements for firearms records.

10. Limitation of Liability

• Auction Armoury shall not be liable for indirect, incidental, or consequential damages arising from the use of our Site or products.
• Our maximum liability in connection with any order shall not exceed the purchase price paid for the product(s).
• Use of firearms and ammunition is inherently dangerous and at your own risk. Auction Armoury disclaims all liability beyond what is required by law.

11. Indemnity

• You agree to indemnify and hold harmless Auction Armoury, its directors, employees, and partners from any claims, damages, or expenses arising from your use of the Site, your purchases, or your breach of these Terms.

12. Governing Law & Disputes

• These Terms are governed by the laws of the Republic of South Africa.
• Any disputes not resolved directly may be referred to arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa, held in Johannesburg, in English.

13. Changes to Terms

• We may update these Terms at any time by posting changes on our Site.
• Continued use of the Site after such changes constitutes acceptance.
